Another Activist Judge Compromises Our National Security


A federal judge struck down parts of the revised USA Patriot Act today and ruled in favor of the ACLU's challenge, saying investigators must have a court's approval before they can order Internet providers to turn over records without telling customers.

U.S. District Judge Victor Marrero agreed with the ACLU that it was improper to issue so-called national security letters, or NSLs - investigative tools used by the FBI to compel businesses to turn over customer information - without a judge's order or grand jury subpoena. Examples of such businesses include Internet service providers, telephone companies and public libraries.

The fact that there are clear precedents in US law for doing exactly this during wartime seems to have been lost on Judge Marrero, who is doing what Leftist activist judges do best...ursurping the legislative function for the sake of a political agenda.

Victor Morrero, by the way, was a Carter cabinet functionary as an Under Secretary of the US Department of Housing and Urban Development, a long time figure in New York Politics as a `leader in the Hispanic community', to use the words of the man who recommended him for his federal judgeship, Senator Chuck Shumer and was appointed by none other than Bill Clinton...so no surprises, hmmm?

This will probably end up back in the Supreme Court.
